CreditLens - Terms and Conditions

1. Definitions
“User” / “You” — means any individual or business entity registering on the Platform.
“Business Information” — means company details, director/shareholder information, contact details, and other business-related data submitted by you.
“Documents” — means bank statements, financial documents, identity documents, and any supporting materials uploaded to the Platform.
“Partner Banks” — means licensed banks or financial institutions regulated by Bank Negara Malaysia.
“Services” — means digital onboarding, document submission, preliminary assessment, and referral of information to Partner Banks.
2. Scope of Services
2.1 The Platform enables Users to:
– Register and create an account
– Submit Business Information and contact details
– Upload bank statements and supporting documents
– Select preferred loan or financing products
– Authorise the transmission of information to Partner Banks
2.2 We are not a bank, lender, or financing provider. We do not approve, reject, recommend, or guarantee any loan or financing application.
2.3 All financing decisions are made solely by Partner Banks, subject to their internal credit assessment, policies, and regulatory requirements.
3. User Eligibility and Representation
3.1 You represent and warrant that:
– You have authority to act on behalf of the business entity
– All information and documents submitted are true, complete, accurate, and not misleading
3.2 You shall not submit any information or documents without proper authorisation from the business owner or relevant parties.
4. User Obligations
You agree to:
– Provide accurate and up-to-date information
– Ensure documents uploaded are genuine and unaltered
– Use the Platform only for lawful purposes
– Not misuse, abuse, or attempt to reverse engineer the Platform
We reserve the right to suspend or terminate accounts suspected of fraud, misrepresentation, or unlawful activity.
5. Data Sharing and Consent Authorisation
5.1 By using the Platform, you expressly consent and authorise us to:
– Collect, process, store, and disclose your Business Information and Documents
– Share such information with Partner Banks for the purpose of loan or financing evaluation
– Share information with third-party service providers strictly for operational purposes
– Use your information to provide you with updates, promotional materials, and marketing communications relating to our products and services (you may opt out of such communications at any time)
– Communicate with you via WhatsApp and other electronic communication channels for service updates, support, and marketing purposes
5.2 You acknowledge that once information is transmitted to Partner Banks, it will be governed by the Partner Bank’s own privacy policies and regulatory obligations.
6. Personal Data Protection (PDPA)
6.1 We comply with the Personal Data Protection Act 2010 (PDPA).
6.2 Personal data collected may include:
– Name, NRIC/passport number
– Contact number and email
– Business registration details
– Financial and banking information
6.3 Your personal data shall be processed for:
– Identity verification
– Loan application facilitation
– Compliance, audit, and regulatory purposes
6.4 We implement reasonable technical and organisational measures to safeguard personal data but do not guarantee absolute security.
7. Credit Information and CRA Act Disclosure
7.1 You acknowledge and agree that the Platform may, where authorised by you, obtain, access, retrieve, verify, process and use your personal information, business information and credit information from lawful sources for the purpose of providing services through the Platform. Such sources may include, but are not limited to:
– Licensed Credit Reporting Agencies (“CRAs”) under the Credit Reporting Agencies Act 2010, including but not limited to Experian Information Services (Malaysia) Sdn. Bhd., CTOS Data Systems Sdn. Bhd., Credit Bureau Malaysia Sdn. Bhd. (CBM) and any other licensed CRA;
– Financial institutions and banks;
– Government agencies, regulators and public registries; and
– Any other lawful data source required for verification or assessment purposes.
7.2 You further acknowledge and agree that where a Company Secretary, accounting firm, consultant, financial advisor or any other authorised representative (“Authorised Representative”) accesses or uses CreditLens on your behalf, you expressly authorise such Authorised Representative to request, access and retrieve your credit information through CreditLens, and such requests shall be deemed to have been made with your full authority and consent.
7.3 Credit information obtained through CreditLens may be used for purposes including but not limited to:
– Creditworthiness and financing assessment;
– Business due diligence and risk evaluation;
– Customer onboarding and verification;
– Fraud prevention and identity verification;
– Financial advisory and recommendation purposes;
– Submission to financial institutions or partners; and
– Any other purposes related to the services requested by you.
7.4 CreditLens shall not retrieve or process credit information without your express authorisation and disclosure to you of the purposes for which such information is obtained.
8. No Guarantee or Financial Advice
8.1 The Platform does not provide:
Loan Approval Guarantees — Approval is at the sole discretion of Partner Banks.
Financial Advice — Any information, credit “scores,” or “readiness indicators” provided by the Platform are for informational purposes only and do not constitute professional financial, investment, or legal advice.
Comparison Accuracy — While we strive to show the best products, we do not warrant that the financing products displayed are the cheapest or most suitable for your specific needs.
9. Platform Fees
9.1 Platform Fees: Access to the Platform for initial document submission is currently free. We reserve the right to introduce service fees in the future, subject to prior notice to Users.
9.2 Success Fees: We may receive a referral fee or commission from Partner Banks upon the successful disbursement of a loan facilitated through the Platform. This does not increase the cost of the loan to you unless explicitly stated.
9.3 Third-Party Costs: You are responsible for any costs incurred from your own bank (e.g., statement retrieval fees) or third-party data providers.
10. Intellectual Property
All Platform content, software, workflows, trademarks, and designs are owned by or licensed to us and shall not be copied or reproduced without written consent.
11. Limitation of Liability
To the fullest extent permitted by Malaysian law:
– We shall not be liable for loan rejection or delays
– We shall not be responsible for Partner Bank decisions
– We shall not be liable for indirect, incidental, or consequential losses
12. Indemnity
You agree to indemnify and hold us harmless from any claims, losses, or damages arising from:
– Any false, inaccurate, incomplete, or misleading information submitted
– Any unauthorised or improper use of the Platform
– Any breach of these Terms
– Any act, omission, or submission made by any third party authorised by you to access or use the Platform on your behalf, including where such third party provides inaccurate, incomplete, or misleading information
You acknowledge and agree that you shall remain fully responsible and liable for all actions, submissions, and communications made by any authorised third party acting on your behalf.
13. Termination
We may suspend or terminate your access at any time if:
– These Terms are breached
– Fraud or misuse is suspected
– Required by law or regulatory authorities
14. Amendments
We may revise these Terms from time to time. Continued use of the Platform constitutes acceptance of updated Terms.
15. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of Malaysia, and the courts of Malaysia shall have exclusive jurisdiction.
